Terms of Service

1. Agreement and Parties

These Terms govern the use of the Kuantayz platform between Kuantayz Bilişim Teknolojileri Ltd. Şti. ("Kuantayz", "we") and the individual or organization using our services ("User", "you").

2. Service Description

Kuantayz is a SaaS platform providing B2B website visitor identification, site health monitoring, domain/SSL tracking, social media monitoring, and Google Business profile management. Services are designed exclusively for business-to-business use.

3. Account Registration

• You must provide accurate, current information when registering.
• You are responsible for maintaining the security of your account credentials.
• Each legal entity may create one account unless otherwise agreed.
• You must notify us immediately of any unauthorized account access.

4. Subscriptions and Billing

• Paid plans are billed monthly or annually in advance.
• Payment is processed via secure third-party providers; we do not store card data.
• You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period.
• We reserve the right to change pricing with 30 days' notice.

5. Acceptable Use

The following are strictly prohibited:

• Using the platform for unlawful purposes or in violation of third-party rights
• Unauthorized access, hacking, or exploiting security vulnerabilities
• Sending spam or distributing malicious content
• Reselling or sublicensing the platform without written permission
• Reverse engineering, decompiling, or disassembling the software
• Sending excessive API requests via automated bots
• Processing personal data in violation of applicable privacy laws

6. Intellectual Property

The platform, software, design, and branding are owned by Kuantayz. You are granted a limited, non-transferable license to use the platform in accordance with these terms. You retain full ownership of your own data.

7. Service Availability

We target 99.5% monthly uptime, excluding planned maintenance and force majeure events. Services are provided "as is" without implied warranties. We cannot guarantee uptime of third-party APIs (Google, social networks, etc.).

8. Limitation of Liability

Kuantayz's total liability for any claim is limited to the subscription fees paid in the preceding 12 months. We are not liable for indirect, incidental, or consequential damages.

9. Termination

Either party may terminate the agreement at any time. We reserve the right to suspend or terminate accounts for material breaches without prior notice.

10. Changes to Terms

We may update these terms. Material changes will be communicated at least 14 days in advance by email. Continued use after the effective date constitutes acceptance of the updated terms.

11. Governing Law and Jurisdiction

These terms are governed by the laws of Turkey. Disputes shall be subject to the exclusive jurisdiction of Istanbul courts. EU consumers retain their statutory rights under applicable EU law.
